Starbase Files New Lawsuit Against Texas AG Over Public Records
Starbase, the small municipality established from Elon Musk’s SpaceX operations in South Texas, has initiated a new lawsuit against Texas Attorney General Ken Paxton. The legal action, filed earlier this month in Travis County, seeks to prevent the release of records that the city argues should remain confidential. This marks the latest episode in a prolonged legal struggle over transparency related to the high-profile launch site.
Since its incorporation in May 2022, Starbase has filed at least four lawsuits against Paxton’s office concerning open-records rulings that mandated the disclosure of various documents. A significant portion of these cases arose from requests made by KVEO reporter Dave Hendricks, who sought invoices and emails involving Starbase’s external legal counsel and SpaceX personnel, as reported by the San Antonio Express-News.
Starbase’s legal team claims these documents are protected under attorney-client privilege, trade secret provisions, or concerns regarding the security of “critical infrastructure.” While Paxton’s office has permitted certain redactions, it has also required the release of other materials. Consequently, Starbase is appealing these decisions in court.

The legal battles coincide with the recent release of nearly 1,400 heavily redacted pages of emails between Texas Governor Greg Abbott and Elon Musk. This release followed a protracted records dispute and, according to many reporters, yielded little useful information despite the extensive censorship. Investigative nonprofit ProPublica covered both the document release and the legal rationale behind the state’s redactions.
Complicating matters, Starbase’s leadership includes several SpaceX employees. Mayor Bobby Peden and Commissioner Jordan Buss both hold roles within SpaceX, raising questions about potential conflicts of interest. Critics argue that a city built around a single employer may struggle to maintain transparency while shielding communications that intersect with corporate activities, as highlighted by reporting from the Texas Tribune.

The Texas Public Information Act serves as the framework for disputes over public records, with the attorney general’s office adjudicating what must be disclosed versus what can remain confidential.
