Starbase Challenges Texas AG Paxton in New Records Lawsuit
Starbase, the company town associated with Elon Musk’s SpaceX operations in South Texas, has initiated another legal battle against Texas Attorney General Ken Paxton. The latest lawsuit, filed in Travis County this month, seeks to prevent the release of records related to the high-profile launch site, adding another layer to an ongoing dispute over public access to communications.
Since its incorporation in May, Starbase has engaged in at least four lawsuits against Paxton’s office regarding open-records rulings that mandated the release of information. The recent cases arise from requests made by KVEO reporter Dave Hendricks, who has sought various invoices and emails involving Starbase’s external legal counsel and SpaceX personnel. Starbase’s legal representatives contend that these documents are protected by attorney-client privilege, trade secret laws, or concerns that their disclosure could expose vulnerabilities in “critical infrastructure.”
Paxton’s office has agreed to some redactions while ordering the release of other documents, prompting Starbase to request judicial intervention to overturn those decisions.

The courtroom battles come in the wake of the Texas state government releasing nearly 1,400 heavily redacted pages of emails between Governor Greg Abbott and Musk, following a protracted struggle for access. Many reporters noted that the heavily edited documents offered little substantial information. Starbase’s leadership is notable for its ties to SpaceX; both Mayor Bobby Peden and Commissioner Jordan Buss hold roles within the company. Observers are scrutinizing whether such a municipality can or should limit transparency in communications related to corporate operations.

The requests from Hendricks specifically target invoices from the Frisco-based law firm Messer Fort and emails with Richard Cardile, SpaceX’s senior manager for spaceport operations. Starbase argues that releasing these invoices would compromise its legal strategy or expose sensitive operational information, including emergency planning and access routes around the launch complex.
The Texas Public Information Act plays a crucial role in this dispute, with the attorney general’s office acting as a mediator in conflicts over what information must be disclosed. This law provides exemptions for common-law privacy, trade secrets, and aspects related to critical infrastructure. Increasingly, agencies and companies are invoking these exemptions to withhold information during public-records disputes.
Legal experts suggest that recent rulings and statutory exceptions have shifted the balance towards greater confidentiality in communications involving public entities and private firms.
