China Boosts Intellectual Property Protection in Photovoltaic Sector

On December 31, 2025, China’s National Intellectual Property Administration (CNIPA) and the Ministry of Industry and Information Technology (MIIT) unveiled a comprehensive set of guidelines aimed at strengthening intellectual property (IP) protection within the country’s photovoltaic industry. The document, titled “Opinions on Further Strengthening Intellectual Property Protection in the Photovoltaic Industry,” outlines a strategic framework consisting of 11 key tasks designed to enhance innovation and protect the rights of enterprises in this rapidly growing sector.

The guidelines emphasize the importance of intellectual property as a driver of innovation and competitiveness in the photovoltaic industry. They aim to tackle issues of intense competition and create a fair market environment, thereby promoting sustainable growth in this vital sector.

Strategic Goals and Implementation

The initiative is guided by Xi Jinping’s vision for socialism in a new era and aligns with the objectives set forth during the 20th National Congress of the Chinese Communist Party. The CNIPA and MIIT call for a collaborative approach that combines effective market mechanisms with proactive government involvement. This approach includes enhancing policy guidance, reinforcing the market position of enterprises, and nurturing a culture that respects intellectual property rights.

By 2027, the Chinese government aims to ensure that intellectual property rights significantly contribute to the healthy development of the photovoltaic industry. The plan includes increasing the number of high-value patents while improving the protection and utilization of existing intellectual property assets.

Key Initiatives for Improvement

Among the highlighted tasks, several key initiatives stand out:

1. **Promoting High-Quality Patent Filing**: Enterprises are encouraged to invest in research and development, particularly in advanced technologies such as TOPCon, back-contact, and heterojunction batteries. The guidelines call for a focus on securing foundational patents for breakthrough technologies, including perovskite and tandem batteries.

2. **Enhancing Patent Examination Efficiency**: The CNIPA will leverage national-level intellectual property protection centers to streamline patent application processes. This includes expediting priority examinations and utilizing alternative examination models to improve application quality and efficiency.

3. **Strengthening Risk Monitoring**: A comprehensive monitoring mechanism for IP infringement risks will be established, covering all stages of the photovoltaic supply chain. This will include creating a database to aid enterprises in navigating the global intellectual property landscape and identifying potential risks.

4. **Facilitating Dispute Resolution**: The establishment of specialized mechanisms for resolving patent disputes in the photovoltaic sector aims to enhance the efficiency of administrative adjudication. This includes promoting collaboration among provincial IP management departments to address infringement cases effectively.

5. **Collaborative Protection Efforts**: An information-sharing mechanism will be set up to enhance cooperation between different governmental departments, ensuring a unified approach to combating IP infringement in the photovoltaic industry.

6. **Overseas Intellectual Property Support**: The plan includes measures to bolster the protection of intellectual property rights for Chinese photovoltaic enterprises operating internationally. This support will help mitigate risks associated with overseas markets and enhance the ability of firms to respond to international disputes.

The CNIPA and MIIT also emphasize the importance of training and capacity building within enterprises, urging them to develop robust compliance management systems to protect their intellectual property rights effectively.
