Kennedy Proposes Overhaul of Vaccine Injury Compensation Program

Health and Human Services Secretary Robert F. Kennedy Jr. is advancing a controversial strategy aimed at reforming the federal Vaccine Injury Compensation Program (VICP), which has compensated patients injured by vaccines since its establishment in 1988. Sources familiar with the planning indicate that Kennedy’s initiative includes expanding the list of injuries eligible for compensation, a move that could inundate the program with claims and potentially lead to its financial insolvency.
The VICP, funded by a small tax on vaccines, has paid out over $5 billion to date. Its primary purpose is to provide compensation for vaccine-related injuries while shielding pharmaceutical companies from litigation that could threaten vaccine supplies. Currently, individuals claiming vaccine injuries must first present their cases to a specialized nonjury court before seeking traditional legal recourse.
Kennedy’s proposed changes to the program include linking vaccines to conditions such as allergies or autism, despite a lack of scientific evidence supporting such claims. Dorit Reiss, a professor at the University of California Law San Francisco, cautioned, “Given the rate of autism, if a lot of cases are brought, that could bankrupt the program.” The Department of Health and Human Services (HHS) has initiated a separate investigation into the causes of autism, which may examine vaccine contributions.
Potential Impact on Vaccine Manufacturers
In addition to modifying eligibility criteria, Kennedy’s strategy may also impose restrictions on vaccine manufacturers. He has suggested a mandate to eliminate a common additive used in vaccines, which could compel companies to either reformulate their products at significant costs or withdraw from the market entirely. Kennedy has publicly stated his intent to address the issues surrounding the vaccine injury fund, asserting on July 28, 2023, via the social media platform X that the fund is “broken” and requires reform. HHS is reportedly collaborating with the Department of Justice to revamp the program, although specific details about these efforts remain unclear.

Reactions to Kennedy’s proposals have been mixed, with some public health leaders expressing alarm at the potential consequences. Angela Rasmussen, a virologist at the Vaccine and Infectious Disease Organization at the University of Saskatchewan, described the approach as a “radical agenda.” She emphasized that the lack of guardrails in Kennedy’s strategy could lead to devastating outcomes, particularly for vulnerable populations.
In response to concerns about his stance on vaccines, HHS spokesperson Vianca Rodriguez Feliciano clarified, “Secretary Kennedy is not anti-vaccine – he is pro-safety, pro-transparency, and pro-accountability.” This statement aims to distance the department from perceptions that Kennedy’s initiatives could undermine public confidence in vaccination.
