These trademarks encompass his voice, likeness, and iconic catchphrases, including the well-known line “Alright, alright, alright” from his role in the film “Dazed and Confused.” This legal strategy aims to prevent unauthorized reproductions of McConaughey’s persona through AI technologies.

The trademarks also cover specific video clips of McConaughey, such as footage of him on a porch and beside a Christmas tree. By establishing this legal framework, McConaughey can pursue legal action against anyone who uses AI to imitate him without his consent. This approach contrasts with state publicity rights laws, which remain largely untested against AI-generated content. McConaughey’s use of federal trademarks offers a more immediate means for legal recourse.

In a statement to The Wall Street Journal, McConaughey expressed his intent to “create a clear perimeter around ownership, with consent and attribution the norm in an AI world.” This proactive stance highlights his commitment to maintaining control over his brand and image as technology evolves.

While McConaughey is defending against unauthorized AI usage, he does not oppose the technology itself. He has invested in ElevenLabs, a voice-cloning company, and is collaborating with them to produce Spanish-language versions of his newsletter, “Lyrics of Livin’.” This dual approach illustrates his willingness to engage with AI while protecting his rights.
