Court Revives Lawsuit Over Parental Rights in Mesa Schools

A lawsuit against Mesa Public Schools has been revived following a ruling from the Arizona Court of Appeals, which found that a parent has standing to pursue claims regarding parental rights. The case, which involves allegations that the school district withheld crucial information about a student’s gender identity, will now undergo further legal proceedings.

In July 2024, a judge from the Maricopa County Superior Court dismissed the lawsuit filed by Rachel Walden, a board member of Mesa Public Schools, alongside a parent of a district student. The lawsuit challenged the district’s guidelines aimed at supporting transgender and gender non-conforming students. According to court records, the parent claimed that the school did not inform them after it learned their child was using an alternate name at school due to uncertainty about their gender identity. The student later reverted to their given name.

The parent criticized school officials for allegedly failing to contact the family immediately upon discovering the student’s feelings. The superior court had previously ruled that the parent lacked standing to sue, deeming the claims “untimely.”

On December 30, 2024, the appellate court issued a decision that reversed the previous dismissal, stating that the parent demonstrated “justiciable controversies” that warrant judicial review. The judges referenced Arizona’s Parental Bill of Rights and the Uniform Declaratory Judgments Act, asserting that if the district’s guidelines are unlawful, the parent has the right to seek a judicial determination.

The court’s opinion emphasized that “if the Guidelines are unlawful, she has the right under the PBOR and the UDJA to seek a judicial determination on whether MPS has interfered with or usurped her parental rights.” In light of this ruling, the case has been remanded to the lower court for further examination of the parent’s claims, while the judges affirmed the earlier dismissal of Walden’s claim.
